Terms & Conditions

These Terms & Conditions apply to arboricultural consultancy services provided by Anthony Jones trading as Jones Arboriculture (“Jones Arboriculture”, “we”, “us” or “our”).
1. Quotations and instructions
Unless stated otherwise, quotations are based on the information available when the quotation is prepared.
A contract is formed when a quotation or instruction is accepted by the client and Jones Arboriculture confirms acceptance of the instruction.
The agreed quotation, correspondence and any written scope of work should be read together with these Terms & Conditions.
If the scope or circumstances materially change, additional work may require an additional fee. Where reasonably practicable, this will be agreed before additional chargeable work is undertaken.
2. Client information
The client is responsible for providing information reasonably required to undertake the instruction, including relevant site information, plans, reports, correspondence and any specific requirements of lenders, insurers, planning authorities or other relevant parties.
Jones Arboriculture is entitled to rely upon information supplied by the client or third parties unless there is an evident reason not to do so.
3. Site access
The client is responsible for arranging lawful and reasonably safe access to trees and areas requiring inspection.
Trees or features that cannot safely or reasonably be accessed may not be fully inspected. Any significant access limitation identified during the inspection will be recorded where relevant.
Unless specifically agreed otherwise, inspections are undertaken from ground level.
4. Nature and limitations of tree assessment
Trees are living organisms whose condition can change.
Arboricultural assessment involves professional judgement based upon the conditions and information reasonably available at the time of inspection.
No tree can be guaranteed to be completely safe and the absence of an identified significant defect does not constitute a guarantee that a tree or part of a tree will not fail in the future.
Weather, disease, damage, site alterations, construction activity and other events occurring after an inspection may materially alter a tree's condition.
Recommendations therefore relate to the circumstances observed at the time of inspection.
5. Further investigation
Where appropriate, Jones Arboriculture may recommend further investigation, monitoring or specialist assessment.
Unless specifically included within the agreed scope, such additional investigation is not included within the original fee.
Resistograph or other diagnostic investigations provide additional information to assist professional assessment and are interpreted alongside the wider characteristics of the tree and site.
6. Reports and recommendations
Reports are prepared for the purpose and client identified in the instruction.
Recommendations represent Jones Arboriculture's professional opinion based upon the agreed scope and information reasonably available at the time.
Where works are recommended, appropriate permissions or consents may be required before work is undertaken, including where trees are protected or situated within a conservation area.
Unless specifically included within the instruction, obtaining such permissions is the client's responsibility.
7. Use of reports and third-party reliance
Reports are prepared for the named client and agreed purpose.
They should not be reproduced, altered or relied upon for a materially different purpose without the prior agreement of Jones Arboriculture.
No third party may rely upon a report unless Jones Arboriculture has expressly agreed to such reliance in writing.
This does not affect any rights which cannot lawfully be excluded.
8. Fees and payment
Fees will be as stated in the quotation or otherwise agreed in writing.
Unless different payment terms are stated on the quotation or invoice, invoices are payable within 14 days of the invoice date.
Jones Arboriculture reserves the right to charge reasonable additional costs arising from material changes to the agreed instruction, additional attendance or work requested by the client, provided those costs are agreed where reasonably practicable beforehand.
9. Cancellation and postponement
Please provide as much notice as reasonably possible if an appointment needs to be cancelled or rearranged.
Jones Arboriculture may charge reasonable costs already incurred or for work already undertaken where an instruction is cancelled after work has commenced, subject to applicable consumer rights.
We may postpone an inspection where weather, access, safety or other circumstances make the work inappropriate or unsafe.
10. Consumer cancellation rights
Where you are acting as a consumer and enter into a qualifying distance or off-premises service contract, you will normally have a statutory right to cancel the contract within 14 days beginning the day after the contract is made.
You do not need to provide a reason.
If you expressly request that Jones Arboriculture begins providing the service during the cancellation period and subsequently cancel before the service has been completed, you may be required to pay a proportionate amount for services supplied up to cancellation, where permitted by law.
If you expressly request that the service begins during the cancellation period and the service is fully performed, you may lose the statutory right to cancel once the service has been completed, provided the applicable legal requirements have been satisfied.
Nothing in these Terms & Conditions limits your statutory consumer rights.
Cancellation may be communicated by email to JonesArboriculture@gmail.com or by any other clear statement communicating your decision to cancel.
11. Professional responsibility and liability
Jones Arboriculture will provide its services with reasonable care and skill.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Jones Arboriculture is not responsible for losses arising from:
- inaccurate or incomplete information supplied by the client or a third party where it was reasonable to rely upon that information;
- circumstances or changes occurring after the date of inspection;
- matters outside the agreed scope of the instruction; or
- use of a report for a purpose or by a person for whom it was not prepared, except where such reliance has been expressly agreed.
Any limitations in these Terms & Conditions are subject to applicable law and statutory consumer rights.
12. Intellectual property
Unless otherwise agreed, Jones Arboriculture retains copyright in reports, photographs, plans and other original material produced as part of the instruction.
The client is granted permission to use and reproduce the final report for the purpose for which it was commissioned, including providing it to relevant professional advisers, lenders, insurers or authorities where reasonably required for that purpose.
13. Complaints
If you are dissatisfied with any aspect of the service, please contact Jones Arboriculture in the first instance so that the matter can be considered and, where possible, resolved promptly.

14. Data protection
Personal information is processed in accordance with the Jones Arboriculture Privacy Notice available on our website.
15. Governing law
These Terms & Conditions and any dispute or claim arising from them are governed by the laws of England and Wales.
Where you are a consumer, nothing in this clause removes any mandatory rights you may have regarding where proceedings may be brought.
